Negligence at a Group Home
Severely handicapped 38 year old woman resided at a group home. She was unable to control or regulate the water temperature when she showered and required complete hand over hand assistance. She suffered second degree burns on her back as a result of the negligence of the group home because the water was too hot. After the shower, and while she was being toweled dry by one of the caretakers of the group home, her skin began peeling off her back.
Settled $600,000.

Products Liability
A 40 year old woman purchased a step stool at a neighborhood discount store. The first time she used the step stool the it shifted or gave way as a result of improper design and improper installation of the attaching devices. In New York the retailer would be a responsible party for the defective Products Liability product. Plaintiff suffered factures to her left knee that required surgery.
Settled $875,000

Medical Malpractice
A 51 year old male suffered from severe osteoporosis and was on disability as a result of his health problems. Decedent fell while walking his dog and suffered fractures to both arms. Decedent was hospitalized for the fractures. While at the hospital decedent was given pain medication and was over medicated, causing severe constipation. Decedent passed away as a result of the poisoning to his system. He left 2 children ages 15 and 17.
Settled $890,000.

Premises Liability
A 58 year old male was on disability for an accident that occurred in 1982 where he injured his back. He was currently residing in a building where the lights went out in the staircase. While walking down the stairs the plaintiff fell because it was dark. The superintendent of the building had known the lights were out for at least 24 hours prior to the accident and had failed to repair them. Plaintiff suffered bruises to his wrist which led to necrosis (lack of blood supply) of the bones in his wrist. Plaintiff has surgery for his wrist.
